Estate agent family face fate in January

Trio charged with up to 47 counts of fraud and theft.

THE fraud and theft trial of East London estate agent Sivuyisiwe Giba, his wife Maureen and daughter Sivuyisiwe, has been set down for the regional court for January 27 next year.

The trio, who appeared in court last week, were arrested earlier this year and face up to 47 counts of fraud and theft dating back to 2005.

Boy Boy Giba was associated with Moreboyz and Kwa Boy Boy Estates.

The Gibas face 13 counts of fraud for allegedly misrepresenting to buyers that properties they believed they had bought would be transferred into their names.

According to the charge sheet, Yazbek Attorneys – which shared premises with Giba’s estate agency – was responsible for the legal conveyancing work in respect of the transfers of houses, arranging bond finance and related activities.

Among the counts is the alleged sale of a property belonging to Marily White in Morningside Road in an exchange agreement with Boy Boy.

White was to take over another house in Bentley Avenue, Willow Park.

However, the Morningside Road house was sold for R600 000 to Justice and Rowena Ezenwa, with transfer occurring directly from White to the Ezenwas.

White was subsequently informed that the Willow Park property could not be registered in her name because Maureen Giba held a large bond over it.

In another matter, Giba registered a property in NU9 Mdantsane in his own name, registering a bond of R90 000 on the property. He allegedly later sold the property to N Mkanzana for R140 000.

However, the property was never transferred into the buyer’s name and the R110 000 she deposited as payment for the property – the remainder allegedly was to have been raised by Giba from a state subsidy – was never repaid to Mkanzana.

Thobeka Skosana was the registered owner of a property in Garcia Street, and agreed to let Boy Boy sell the house for R720 000.

Of this, R500 000 allegedly was to be used for the purchase of a new house in Dutton Road, Cambridge, but this property was never transferred into Skosana’s name.

Pindiswa Godlo’s property allegedly was sold to and registered in the name of Maureen Giba and a property in Beacon Bay, owned by Maureen, which was to have been transferred into Godlo’s name, was never transferred.

Yazbek Attorneys allegedly arranged a bond of R100 000 for Boy Boy to buy the house, which Luvuyo Maqoma had inherited from his deceased mother, Nontsapo.

However, the charge sheet states that other documents in the Yazbek file, including a power of attorney in favour of Allen Clarke, could not have been signed as Nontsapo “was deceased at the time”.

The accused also face 25 counts of theft for allegedly stealing R2.6-million from clients in various fraudulent schemes.

They are also charged with fraud for collecting rentals after their estates were sequestrated. —
