Government's Al Bashir appeal denied

Judge Hans Fabricious has denied government’s petition for leave to appeal against the decision that it was obliged to arrest Sudanese President Omar Al Bashir and hand him over to the International Criminal Court.

South Africa was severely embarrassed when it was revealed that Al Bashir had been allowed to leave the country in direct violation of the court order‚ but government said it was confident it was correct not to arrest Al Bashir.

Judge Fabricious dimissed the appeal application with costs‚ saying that Al Bashir enjoyed no immunity and that South Africa was obliged under the ICC’s Rome statutes to arrest him and hand him over.

Al Bashir is wanted on war crimes.

Al Bashir had been attending an African Union summit in Johannesburg at the time of the original court ruling.
