Convicted fraudster and former Buffalo City Metro mayor Zukisa Faku will hear the outcome of her application for leave to appeal next week.

Faku was this week sentenced to three years’ house arrest and community service after she was convicted of nine counts of fraud.

Yesterday, magistrate Sadia Jacobs heard Faku’s application for leave to appeal.

Faku’s legal representative, advocate Sakhele Poswa, told Jacobs that they wanted to appeal both the conviction and sentence.

“Credit card user guidelines were never discussed. There were no terms and conditions set out. She was neither a director or senior manager. She was a councillor and politician,” Poswa said.

Prosecuting state advocate Elna Smit said: “She knew she could not use public funds for personal gain and she also knew that the credit card was public funds.”

Smit said the sentence handed down by Jacobs was more than appropriate and that another court would not interfere.

Jacobs said she would give judgment on the application on October 6. — Siya Boya
