Leave to appeal nullifying ORT conference granted

Badanile Mntamo, the disgruntled ANC member who wants the courts to nullify the outcomes of the 2015 OR Tambo regional conference, has been granted leave to appeal by the Mthatha High Court.

Mntamo and another ANC member Mlandeli Ndabetha from Port St Johns had taken their party to court last month seeking to have the regional elective conference from two years ago overturned claiming they were irregularities in the buildup to it.

However their case had been dismissed by Mthatha High Court Judge Selby Mbenenge on the basis that they had taken too long to bring the matter to court.

Today, however Mbenenge granted Mntamo leave to appeal the judgment. 

The ruling was read out by acting High Court Judge Mpumelelo Notununu who took only two minutes reading it out.

"The applicant is granted leave to appeal to the full court of this division,” Mbenenge's judgment read.
