Council to decide on Fani’s fate next week

Buffalo City Metro municipal manager Andile Fani will know his fate next Wednesday when council is due to meet again.

Three weeks ago, council instructed executive mayor Zukiswa Ncitha to write to Fani and give him seven days to give reasons why he should not be suspended.

In her letter to the accounting officer, Ncitha demanded Fani account for allegations of tampering with a tender box and explain why he failed to inform her about a national Treasury investigation into how more than R600-million had allegedly been irregularly spent in the 2013-14 financial year.

The seven days lapsed on May 1 and in a dramatic turn of events, Fani submitted an affidavit to the Hawks.

In his submission Fani accused Ncitha, council speaker Luleka Simon-Ndzele and mayoral committee member Sindiswa Gomba of flouting their bail conditions by participating in the April 29 council meeting that resolved to put him on leave of absence.

The three are among nine people facing criminal charges in court for their alleged involvement in swindling more than R5.9-million meant for preparations for memorial services of Mandela.

Fani is a state witness in the case.

Hawks Captain Luphumlo Lwana obtained warrants of arrest for Ncitha, Simon-Ndzele and Gomba to appear in court voluntarily to explain their role in the April 29 council meeting.

Fani, however, failed in his bid after the court dismissed the case against the three politicians.

A report on Fani’s conduct was due to be tabled at a special council meeting last week.

However, it did not materialise as ANC councillors could not agree on whether or not to put it on the council agenda. Acting speaker Sithembiso Tyilo adjourned the meeting after three hours of debating.

Ncitha, Simon-Ndzele and Gomba were in court on the day and did not attend the council meeting.

The office of the council speaker placed an advert in yesterday’s Daily Dispatch, informing the public about a council meeting scheduled for next Wednesday.

The mayor’s spokesman, Sibusiso Cindi, yesterday confirmed the council meeting.
