Winnie lawsuit delays Madiba estate

Beneficiaries of former president Nelson Mandela’s estate have approached Winnie Madikizela-Mandela’s lawyer complaining that the distribution of the will is being delayed by her pending case.

The Daily Dispatch has seen letters to the state attorney and counsel of the executors in which Madikizela-Mandela’s lawyer states that some beneficiaries approached his office.

Madikizela-Mandela wants the Qunu property, where Mandela lived when he was in the Eastern Cape.

She claims it belongs to her and she was shocked when Mandela gave it to his third wife Graça Machel, who has the “whole world in Mozambique”.

In his will, Mandela bequeathed the Qunu property to the Nelson Rolihlahla Mandela Family Trust on behalf of the Mandela family, Machel and her children.

So far the state attorney and executors have filed notices to oppose the matter, but have yet to file answering affidavits.

Madikizela-Mandela’s lawyer Mvuzo Notyesi’s letter to the state attorney, representing the Presidency, read: “Our office has been approached by some of the beneficiaries in the last will of the late president Nelson Rolihlahla Mandela who advise … that the distribution of the will is being delayed by the pending case.”

Notyesi said the beneficiaries were “assured” the matter was not being opposed by the president or minister of land affairs.

He declined to reveal who the beneficiaries were.

Beneficiaries include Mandela’s children and grandchildren including Ndaba Mandela – who has not been vocal about the pending claim – Madikizela-Mandela’s grandson Gadaffi, Makaziwe Mandela’s children, Mandla Mandela, and Machel’s children and grandchildren.

In another letter to the executors, Madikizela-Mandela states: “They equally requested the writer to approach yourselves to find the best way to expedite the finalisation of the matter where possible.

“In this regard, we seek the quickest possible ways that can be agreed in order to bring this matter before court for hearing and finalisation for the benefit of those parties that have interest in the distribution of the assets and finalisation of the estate.”

In response, the executors’ legal counsel, Ledwaba Mazwai attorneys, wrote that the executors planned to file a replying affidavit, “upon the consideration of the deeds, land affairs minister, the presidency and Graça Machel’s affidavits”.

Machel has yet to show any interest in the matter by filing a notice to oppose. — abongilem@dispatch.co.za
