Upmarket East London champagne bar, OhBrigado may soon shut down because of a failure to pay thousands in rent owed to the landlord.

Slip Knot Investments 777 (Pty) Ltd, which owns Beacon Bay Crossing, have asked the East London High Court to direct the sheriff to attach movable assets belonging to OhBrigado in order to recoup monies owed.

Yesterday Judge Selby Mbenenge granted an order in Slip Knot’s favour saying the assets may be attached but may not be moved.

“Such attachment is obtained in one or more of the following methods; the locking of the leased premises, compiling an inventory of the movable property or affixing to such movable property a mark or sticker identifying the property,” part of the order reads.

Slip Knot’s Jean du Plessis filed an affidavit in which he stated OhBrigado owed R108741.82 in unpaid rent.

According to Du Plessis, Slip Knot entered into an agreement with OhBrigado for a four-year lease.

OhBrigado and its owner Olwethu Hoyana have been cited as respondents.

“ has failed and refused to effect payment of all the rental and utilities instalments,” he said.

The matter in court is in two parts. In part A, Slip Knot is asking the court to attach OhBrigado’s assets pending Part B. In part B, Slip Knot is asking the court to order the sheriff to remove the assets, for Slip Knot to have a money judgment in their favour and for OhBrigado to be evicted.

Yesterday the matter was on the unopposed roll and OhBrigado was called upon to show just cause why they should not be evicted.
