Man loses court battle to attend Eastern Cape funeral

Mpumalanga High court has dismissed an application by a Hofmeyer man currently living in Mbombela who wanted to travel to the Eastern Cape to attend the funeral of his grandfather.

Acting Judge Roelofse held that Karel Van Heerden is prohibited by the law from traveling between provinces, however urgent and deserving the circumstances.

“The (Disaster Management Act) and final lockdown regulations applies to everyone within the borders of the republic,” said Roelofse.

He said if he granted Van Heerden’s application, “I will be authorizing (him) to break the law under judicial decree - that no court can do.”
