Court hears of deadly WSU attack

The fourth witness in the murder trial of five former Walter Sisulu University students said he was attacked by three of the accused on the night of the incident.
Siphesihle Mafungwa, 21, Yamkela Mxokozeli, 23, Sindile Kango, 21, Philani Danca, 23, and Lwakhe Matakane, 20, stand accused of killing medical student Lwando Mantshontsho in May last year.
They also face two counts of housebreaking and two counts of attempted murder.
State witness Dr Khangelani Wilson appeared before the Mthatha high court on Monday and testified that on the night of the incident he was in his room studying when one Ayabonga Duba, one of his friends, reported that they were being assaulted at Kuwait residence by a group that consisted of some of the accused.
He said the friends who were assaulted included the deceased and Dr Solomzi Fobo who had already testified in court.
He also testified that Mafungwa was pointed out as the one who had done the assaulting.
Wilson said upon hearing the story from Duba, together with other friends, they approached the room where Mafungwa was but could not speak to him and went back to their rooms.
“When I got back to my room in Atlanta [residence] I locked the door and burglar gate and continued to study until I heard a knock but decided not to open but then heard the gate making a creaking sound.
“I opened the door and saw accused four [Danca] and five [Matakane] and I saw them bending the burglar gate and asked them what they wanted, the response was that they wanted to chat,” said Wilson.
He said at that time Kango was breaking the windows.
“In that instance when I realised the burglar gate was bent I closed the door and heard another noise as though the door was being cut. When I realised that the door was almost completely cut, I opened the door and Danca came in,” he said.
Wilson further testified that he went out of the room with Danca holding him in a strangling position while Matakane punched him.
He said Danca had a knife and made as if he was going to stab Wilson.
“Then Mafungwa appeared topless and in his hand had a chain with a padlock and wanted to hit me on the ankles with it,” said Wilson.
Judge Buyiswa Majiki said she would like to go through the evidence before cross examination as it had introduced new aspects and the matter was postponed to Tuesday...
