The R100m tender awarded to Cape Town based Quality Filtration Systems (QFS) for drought stricken Port Alfred was on Tuesday struck down as unlawful by the Grahamstown high court.
Judge Phillip Zilwa found the tender tainted, irregular and unlawful and set it aside, along with the subsequent contract concluded between Ndlambe Municipality and QFS.
Ndlambe Municipality hastily paid out R20m in May to the QFS before it had even signed the contract with the company which Zilwa said he found both questionable and shocking. He said QFS should immediately “effect restitution” and repay the money.
