Accused teen applies to stay out of court

Selborne College pupil Kolunga Onamandla Zuma is applying for a permanent stay of prosecution from the director of public prosecutions office in Grahamstown.

The 17-year-old, who allegedly caused the deaths of two friends when the car he was driving ploughed into a tree, appeared in the East London Magistrate’s Court on Thursday. He was in the company of his mother Zilungile Zuma. State prosecutor Asanda Nolusu told presiding magistrate Rochelle Sam that the case should be postponed to next month, as Zuma wished to make representation with the DPP “for a possible consideration of not being prosecuted” on two counts of culpable homicide and one of driving without a licence.

The case was postponed to December 21 for the DPP’s decision.

The accident happened during the early hours on Saturday April 23.

Zuma was driving a Renault Duster, allegedly without permission, in the company of four friends and fellow pupils.

They were returning from Buccaneers’ Sports Pub and Grill at the beachfront, when the vehicle smashed into a tree on Gately Street, midway between St Marks and St Andrews roads in Southernwood.

Two boys who were part of Selborne’s under-16C rugby team, Avuyile Ngqele and Sihlumile Bandile, died due to the crash.

Ngqele died at the scene and Bandile at Frere Hospital.

At the time, former transport department spokesman Ncedo Kumbaca told the Dispatch that moments before the accident, one of the boys’ parents had phoned asking where they were.

“They said they were at home,” Kumbaca said.

“The parent said impossible because ‘we’re home’. The boys rushed home and collided with a tree.” — zwangam@dispatch.co.za
