Mthatha court to rule on ANC councillors

SUSPENDED ANC councillors from Mbhashe Municipality will hear their fate on Friday when the Mthatha High Court rules on whether their expulsion from the municipality was lawful.

The court has asked for transcripts from the ANC’s disciplinary hearing that took the decision to suspend them from the party and remove them from the council.

The case was first heard last Friday but was postponed after the presiding judge took ill.

Yesterday the case was set down for Friday after the court asked the ANC to hand over the transcripts .

Speaking to the Daily Dispatch outside the court , former mayor Mthetheleli Bhele said they were disputing the procedure followed in their disciplinary process.

“Our party charged us for accepting a report and following up on it and removing the people involved in corrupt activities.

“When we went to the disciplinary hearing we waited there until the set time passed. We waited for more than an hour and there was no one. After we left, we heard the committee took the decision to remove us and they never even made the effort to inform us.”

Bhele said the fact the provincial leadership was targeting them for curbing corruption made them (councillors) suspicious.

The Mbhashe council removed Mayor Nonceba Mfecane last year after a municipal public accounts committee (MPAC) found her guilty of corruption and recommended she be removed.

Mbhashe has been in turmoil since this term of local government commenced in 2011, with glaring differences between those who support Mfecane and those supporting speaker Phakamisa Madingana.

Mfecane was later removed after being implicated by the MPAC in improperly issuing infrastructure tenders worth R28-million . — /
