Dalindyebo refuses to back down as court battle rages

OUTSPOKEN AbaThembu King Buyelekhaya Dalindyebo has vowed he will not be silenced, wished away or dethroned.

On Monday, Dalindyebo’s legal team received a letter from the state attorney saying they could not file the papers because Zuma was overseas on “official international duties”.

In the same letter they said Zuma’s answering affidavit was “ready to be signed and served”.

The letter further reads: “We therefore seek indulgence for postponement of the matter to enable us to have an opportunity to engage about issues contained in the draft answering affidavit.”

In response, Dalindyebo’s legal team pointed out the contradictions in the letter seeking a postponement. They said Zuma had long returned from Russia when the deadline to file was missed.

“Given the admission that the answering affidavit was ready, only awaiting his signature, there was no reason not to file it with a condonation application for the lateness,” Dalindyebo’s legal team said.

In the press conference yesterday afternoon Dalindyebo confirmed that Economic Freedom Fighters (EFF) national leader Julius Malema and DA provincial leader Athol Trollip would be in Mthatha on Friday to support him.

He described Zuma as a hypocrite for setting deadlines and expecting them to be met but failing to do the same when they were imposed on him.

“The fact that have distanced themselves shows they will not be influenced. The pack of Zuma’s lies is beginning to unfold. I am feeling vindicated,” said the king.

Dalindyebo said Zuma had a political vendetta against him because he had left the ANC for the DA. He said his legal team would oppose the postponement on Friday.

If the state attorney intends to ask for a postponement, procedurally they should make an application in court giving the judge reasons why they cannot proceed.

The king would then oppose it and the court would have to rule on the matter. — siyab@dispatch.co.za
