McBride matter not urgent: judge

The application for an interdict brought by Independent Police Investigative Directorate (Ipid) head Robert McBride is not urgent, the High Court in Pretoria ruled today.

“The facts do not support the relief sought, nor the applicable legal considerations. It is accordingly struck off the roll,” Judge Hans Fabricius said in a written judgment.

McBride was seeking an urgent interdict to prevent his suspension from Ipid. Police Minister Nathi Nhleko opposed McBride’s application.

McBride received a letter from Nhleko on Wednesday last week, asking him to make submissions by the end of the day about why he should not be suspended.

McBride’s lawyer Steven Budlender confirmed that McBride had not yet been suspended and that, according to discussions in Chambers, it was agreed he would not be suspended until judgment was delivered.

He asked the court to declare the minister’s decision unlawful and invalid, and sought an order declaring unlawful provisions giving the minister permission to suspend the head of an independent body.
