JSC expecting more reports over judge’s alleged racist rant

The Judicial Service Commission (JSC) said on Tuesday that more people have indicated that they will be lodging complaints against Johannesburg High Court Judge Mabel Jansen for her alleged racist utterances.

JSC spokesperson Sello Chiloane said the commission would consider the matter once it has received the complaints.

“People have indicated that they are going to lodge a complaint. When a complaint is received‚ it will be referred to the Judicial Conduct Committee.”

Chiloane said any person can lay a complaint against a judicial officer when‚ among others things‚ they breach the JSC’s code of conduct.

Political parties and activist groups have called out for Jansen’s dismissal.

The Black Lawyers Association (BLA) said Jansen’s utterances were not befitting a person who occupies her position.

“For a judge to hold a view that black people are‚ in terms of their culture‚ rapists and murderers is so unacceptable that she cannot be found to be fit and proper person‚ as is required under section 174 of the Constitution‚ to continue to occupy a position of judge‚” the BLA said in a statement.

The Democratic Alliance said this week that it will lay a complaint against Jansen with the JSC.

“The judge’s comments that rape is part of black culture is not only hurtful and demeaning‚ but fundamentally undermines the dignity of our people‚ and in doing so‚ violates the Constitution of the Republic of South Africa‚” the party said in a statement.

The African National Congress (ANC) has called for Jansen to be banned from appearing in any court.

The ANC Women’s League has also expressed its disappointment at Jansen’s comments.

“The ANCWL is disappointed by the likes of Judge Jansen who is supposed to uphold the rule of law in an objective and unbiased manner‚ defining rape as a black culture.”

Jansen came under fire this week for saying that rape is part of black men’s culture. She made the comments in a private conversation with Schutte‚ a filmmaker‚ who then made the comments public.
