Prosecutor calls out Krejcir's lawyer for abuse

Radovan Krejcir’s lawyer has been accused of abusing the legal process by State prosecutor in the murder trial at the Johannesburg High Court.

Prosecutor Lawrence Gcaba has called out Krejcir’s lawyer for asking for a full disclosure saying the State has made all necessary information about the trial available to the defence.

This comes as the State had to reply on Wednesday to requests made by the defence counsels for Krejcir and his four co-accused.

Gcaba said the court should apply a test of whether the refusal of any more information would jeopardise the accused.

“The State is under no obligation to disclose evidence of which it aims to use in the trial. Some of the particulars should not have been asked for by the defence. It’s an abuse of the process‚” Gcaba said.

He said the only information that should be given to the Krejcir’s counsel was what it needed to prepare its defence‚ nothing more.

“Why abuse the process? Why waste the court’s time asking for something that the State has already said it does not know or have the details of‚” Gcaba lamented.

Gcaba said he was willing to provide information the State would lead as evidence should the court find in the favour of the defence.

Krejcir‚ Siboniso Miya‚ Nkanyiso Mafunda‚ Siphiwe Memela‚ and Luybomir Borislavov Grigorov‚ are accused of murdering alleged drug kingpin Sam Issa.

The five men are also facing charges of conspiracy to perform a robbery‚ two charges of conspiracy to murder and of possession of an illegal firearm and ammunition

Judge Winston Msimeki postponed the matter to May 23.
