Pinetown truck driver back in court

The truck driver who crashed into four taxis and a car killing 22 people is expected to appear in the Pinetown Magistrate's Court on Monday.

Sanele Goodness May, 23, from Swaziland, was arrested on September 6 on 22 counts of murder and one of reckless or negligent driving.

Magistrate Wendolynn Robinson postponed the case to Monday, but said a formal bail application would take place on September 18.

Defence attorney Theasen Pillay confirmed that he had been appointed by Sagekal Logistics, the company which owned the truck, to represent May.

May was initially charged with culpable homicide, but National Prosecuting Authority spokeswoman Natasha Ramkisson confirmed that the charges had been upgraded to murder.

The accident occurred when the articulated truck hit four fully-laden minibus taxis and a Volkswagen Golf on the corners of Fields Hill (M13) and Richmond roads in Pinetown shortly before 7pm on September 6.

KwaZulu-Natal Health MEC Sibongiseni Dhlomo said the death toll was now at 23, after one of those injured in the accident died in hospital on Saturday morning.

TRUCK DRIVER TO GET NEW LAWYERS

The lawyer for the driver of an articulated lorry which killed 23 people when its brakes failed has withdrawn from the case. Theasen Pillay, who was appointed by Sanele Goodness May's employer Sagekal Logistics to defend him, told the Pinetown Regional Court on Monday that he was withdrawing from he case.

He said three other attorneys had arrived at court to defend May.

He was initially charged with 22 case of culpable homicide, but this was subsequently upgraded to 22 cases of murder and a charge of reckless or negligent driving.

A 23rd person injured in the crash died on Saturday.

It was not immediately clear who would represent May and the matter was adjourned to later in the day.

May is also expected back in court on Wednesday, when his formal bail application is expected to be heard.
