Walus parole on hold until appeal is heard

The Supreme Court of Appeal has granted Justice Minister Michael Masutha leave to appeal in the parole application of Janusz Walus‚ the murderer of popular liberation fighter Chris Hani.

In March‚ the high court ordered that Walus be released within 14 days.

The Supreme Court of Appeal’s order means he will remain behind bars at least until it has heard and decided the case.

Judge Nicolene Janse van Nieuwenhuizen had refused him leave to appeal‚ saying the bid had no reasonable prospect of success.

This meant Masutha had to petition the SCA to hear his appeal.

In the meantime‚ Janse van Nieuwenhuizen refused Walus’s application to be released from custody‚ pending the minister approaching the appeal court.

In an order by Justices Azhar Cachalia and Malcolm Wallis dated July 4‚ the Supreme Court of Appeal ordered that the leave to appeal had been granted.

The high court’s order in March was greeted with dismay by Hani’s widow Limpho, who called the judge racist‚ and the South African Communist Party‚ which said it was still seeking the truth about Hani’s murder.
