DA in court over affidavits in Jiba case

The Democratic Alliance (DA) will be in court on Wednesday in a bid to bolster its case to force the suspension of National Prosecuting Authority’s (NPA) “second-in-command‚ Nomgcobo Jiba‚ pending the outcome of a long overdue disciplinary inquiry”.

The party’s James Selfe said the Western Cape High Court will hear its application “seeking the inclusion of affidavits deposed to” by former National Director of Public Prosecutions (NDPP) advocate Mxolisi Nxasana and the NPA’s head of the Asset Forfeiture Unit‚ advocate Willie Hofmeyer.

“In our founding affidavit‚ the DA submits that‚ given the prima facie evidence of Jiba’s long list of failings and improper conduct‚ President Jacob Zuma should suspend her pending a formal inquiry into her suitability to continue as the deputy national director of public prosecutions at the NPA‚” said Selfe.

“This comes after Nxasana asked Minister of Justice and Correctional Services Mike Masutha and Zuma to suspend Jiba on several occasions following a judicial probe into management at the NPA.

“The probe recommended that she be criminally charged for fraud and perjury.”

Nxasana‚ himself‚ was in July 2014 the subject of an inquiry‚ announced by Zuma‚ into whether he was fit and proper to hold office. He eventually stood down from his position as NDPP on the May 31 last year.
