Accused mob in bail bid

A group of Mdantsane residents accused of beating and torturing a man to death will appear in court today for a formal bail application.

Bail was initially opposed when the men, now charged with murder, first appeared in the Mdantsane Magistrate’s Court on December 31.

The victim was Luyanda Baxa, 33, who was killed on December 1 after he allegedly stole R35 from a pool table at a tavern in Silvertown squatter camp near NU1.

Ten people, six women and four men, were arrested on December 29 and charged with the murder.

They are tavern owner Amanda Ngxovu, 29, Lwandile Malawana, 29, Luvuyo Tutine, 36, Thozamile Mbayo, 39, Luvuyo Kwetana, 36, Nomthandazo Jacob, 38, Buyiswa Makinana, 41, Phakama Mbayo, 31, Buyelwa Ngxovu, 50, and Babalwa Mbayo, 31.

According to the charge sheet Baxa, who was raising a five-month-old daughter with his girlfriend, was tortured and assaulted with open hands, fists, empty bottles, planks and a hammer. He succumbed to his injuries and died on the scene.

The victim’s niece, Ntombokuqala Ndwayana, said her uncle had worked at Da Gama textile factory.

“He was on his way to apologise for stealing the money when he was beaten and killed that night.”

She said the family was called to the scene by the man’s girlfriend.

“It was at night. We found him in the bush where he had tried to escape before they caught up with him and finished him off.

“He had no eyes, they had also removed all his teeth and his skull was crushed. His girlfriend told us they also threatened to burn him and his shack down,” said Ndwayana.

In opposing bail, prosecutor Akhona Maya told magistrate Donna Marais the accused were facing a Schedule 6 offence in that they knowingly and intentionally killed the victim.

It was then that the magistrate transferred the matter to bail court.

The court is expected to take three days to listen to each accused’s case in considering the granting of bail. — zwangam@dispatch.co.za
