Rape accused claims ‘victim’ consented to sex

A Nompumelelo man has denied raping a woman numerous times saying they were lovers and that the morning after the alleged rape, she even undid the plaits in his hair.

Ayanda Pike, 27, appeared in the East London High Court where he pleaded not guilty. The woman cannot be named to protect her identity as a rape victim.

It is the state’s case that on April 12 last year the complainant had a fight with her boyfriend and went to her brother’s shack.

He was not home but Pike arrived and offered to help her look for him.

According to the indictment, they walked along a footpath and when near the local school the accused tried to hug her. She pushed him away he pulled out a knife.

“He ordered her to undress and raped her twice,” part of the indictment reads.

It is alleged that he took her to his shack where he raped her twice again.

“Early the next morning, Pike raped the complainant a fifth time and he allowed her to leave,” the papers said.

The complainant told a friend of her ordeal and the matter was reported to the police. Pike was arrested the following day after she pointed him out to police.

On Wednesday Pike testified before Judge Belinda Hartle telling her he was in a secret love affair with the complainant. “I did not rape her. It was consensual.

“Even when we were doing it, it was not like rape. We kept our relationship a secret because the boyfriend was financially maintaining her child. I said I would help her with the child as well,” Pike said in court.

“Before we fell asleep I asked her to undo my plaits in the morning and she agreed. When I woke up she was already awake and she undid my plaits. She then left,” he said, adding that he could not accompany her because they did not want to be seen by her boyfriend.
