Man in court for rape of girl, aged 12

A Gompo man allegedly told his ex-girlfriend’s daughter to undress so he could take her measurements for Christmas clothes before raping her in 2014.

The 42-year-old man cannot be named to protect the identity of a victim of sexual assault. She was 12 years old at the time of the alleged crime.

Yesterday, the man pleaded not guilty in the East London High Court.

State advocate Nickie Turner said that if found guilty, the state would ask for a life sentence.

It is the state’s case that, on October 25 2014, the child was left at home alone while her mother went to work and her older brother was out with friends.

The accused, who was known to the girl, arrived at their home and ordered her to the bedroom to undress so he could take her measurements for clothing.

She complied but refused to take off her panties.

According the indictment, he then threatened her with a “sword”, a pair of scissors and a belt.

He allegedly tied her hands and legs and raped her.

She managed to untie herself after he left.

When her brother arrived she told him what had happened and their mother was contacted at work.

The girl was taken to a doctor that day.

Medical evidence indicated injuries from forced penetration.

Defence attorney Hendrik Erasmus, said his client would testify he did not rape the child.

The defence would argue that the case was a result of a conspiracy between the mother and her two children because the accused had ended the relationship and left the family stranded.

He would deny being in Duncan Village on the day and would bring a witness to corroborate his whereabouts.

A neighbour took the stand yesterday and testified seeing the accused in Duncan Village on the day.
