An Eastern Cape doctor who allegedly threatened an attorney he accused of sleeping with his wife, has found himself on the wrong side of the law.
The parties cannot be named because they are embroiled in a bitter divorce and have two minor children.
The doctor, 45, appeared briefly in the East London Magistrate’s Court last week where he was granted R5000 bail.
He is facing charges of contravention of a protection order, malicious damage and attempted murder.
It is alleged the doctor arrived at his Gonubie apartment in the early morning last week and found a BMW parked outside. He allegedly used a brick to smash all the windows.
The doctor’s 37-year-old wife is named as a complainant.
In a statement, the woman claims that around 6.30am last Thursday, she was home with her children and nephew when they heard noises coming from outside. The nephew looked outside and saw her husband smashing the car.
“I then quickly took the kids into the bedroom and locked us in. He continued to break the other bedroom window … He then hit the locked door with a brick and forced it open.
“He threatened to kill me if I did not go and sign the divorce and give him everything and the kids,” she claimed in the statement.
She further alleged the man stopped with the threats when her nephew intervened, but promised to return.
The attorney, accused of being involved in a love triangle with the doctor’s estranged wife, told the court he had accompanied the doctor’s wife, his client, to have blood tests with her children a day before the alleged incident.
It was alleged the doctor had disputed paternity. The lawyer is representing the woman in the divorce.
The attorney further claims that while in the reception area, the doctor started talking to his wife, but he advised against it.
About 45 minutes later, when he was back at his office, the doctor arrived and allegedly demanded to see him. His secretary told him to lock his door.
“I immediately realised there was going to be trouble,” the attorney said in his affidavit.
“ then walked towards my door and banged on the door shouting that I was sleeping with his wife and that he was going to kill me,” the attorney said.
The panic button was activated and the doctor left. The attorney asked the police to open assault and trespassing charges against the doctor.
The secretary, in a affidavit, also claimed the doctor had been carrying a hammer when he arrived at their office. “I was very scared because he was very aggressive,” she said. The doctor will be back in court on June 13. — siyab@dispatch.co.za
